For nearly three years, our team has been pursuing litigation on behalf of foster children in Oregon.

Standing Up for Our Most Vulnerable

The lawsuit, led by Disability Rights Oregon and A Better Childhood, aims to hold the state accountable for its ongoing failure to appropriately, compassionately care for the victimized children it is supposed to protect.

This past fall, our team secured a huge win in the case, as a federal judge rejected the state’s motion to dismiss and allowed the suit to move forward as a class action on behalf of more than 8,000 children in the system.

The plaintiffs included a 17-year-old Native American boy who had lived in at least 50 different foster placements, none with tribal members.

This is a crucial step in the effort to force reforms and provide these children—including children with disabilities and those who identify as LGBTQIA+—with the care they so urgently need.

A DWT team led by Andrew McStay has provided litigation strategy and advice, while paralegals Jennifer Davis and David MacKenzie have been crucial in managing the extensive document production.
